Mediation, Not Litigation:
Principles and Values of Mediation and Law Practice
Dayton Cole’s legal career has been focused on preventive practice— helping a wide range of institutional and individual clients achieve goals, while avoiding costly disputes. As a certified North Carolina Superior Court mediator, he adheres to the rules and policies of the Supreme Court and the Dispute Resolution Commission, including Standards of Professional Conduct for Mediators originally adopted by the Supreme Court in 1995 and amended in 2014.
An Objective Perspective
The hallmark of an effective mediator is neutrality. The mediator is neither judge nor advocate, but rather an objective, neutral third party who facilitates voluntary agreement between two or more parties to resolve disputes.
While the primary responsibility for resolution of a dispute rests with the parties, the role of the mediator is to facilitate communication among the parties, help them identify issues, and help them explore opportunities for settlement, reconciliation and understanding.
Dayton Cole is committed to listening carefully, understanding the needs and interests of all parties, and helping them craft settlement agreements that address those needs and interests to the extent possible. Throughout his career, Dayton has developed strong, positive relationships with his clients, members of the bar, and trial and appellate judges. Those relationships are based on integrity, mutual respect, and a sincere desire to serve.
